2. What data is collected
- Data you send: when you use the contact form, write an email or send a WhatsApp message, I receive the details you provide, such as your name, email address, company, boat details, place and date of the shoot, and your message.
- Technical data: the hosting provider records standard server logs (IP address, browser type, pages requested, date and time) to keep the site running and secure. Anonymous visit statistics are also collected, without cookies (see section 4).
- Third-party content: see section 5.
3. Purposes and legal basis
- Replying to enquiries and preparing quotes: steps taken at your request before a contract (Art. 6(1)(b) GDPR).
- Carrying out commissions, invoicing and accounting: performance of a contract and legal obligations (Art. 6(1)(b) and (c) GDPR).
- Site security and protection against abuse: legitimate interest (Art. 6(1)(f) GDPR).
- Anonymous statistics on how the site is used, to improve it: legitimate interest (Art. 6(1)(f) GDPR).
Providing your details is optional, but without them I cannot reply to your enquiry.
4. Cookies
This site does not use advertising or profiling cookies, and sets no cookies of its own. Visit statistics are collected with Cloudflare Web Analytics, which uses no cookies and does not follow you across other sites. The contact form, provided by Jotform, may use technical cookies it needs to work, including those of Google reCAPTCHA, which protects it from spam. YouTube may set cookies only after you choose to play a video (see section 5).
5. Third-party services
- Jotform (Jotform Inc., USA): the contact form is provided by Jotform. What you enter is sent to Jotform and stored in my Jotform account, under Jotform’s privacy policy.
- Google reCAPTCHA (Google Ireland Ltd): the “I’m not a robot” check in the contact form, used only to block spam. To do this Google receives technical data such as your IP address and how you interact with the page, under Google’s privacy policy and terms.
- Cloudflare Web Analytics (Cloudflare Inc., USA): counts page views anonymously, without cookies or fingerprinting. To deliver its script, Cloudflare receives technical data such as your IP address and browser type, under its own privacy policy.
- Google Fonts (Google Ireland Ltd): the typefaces of this site are hosted on the site itself. Only the contact form, provided by Jotform, loads a typeface from Google servers, which then receive your IP address.
- YouTube (Google Ireland Ltd): videos use YouTube’s privacy-enhanced mode and nothing is loaded from YouTube until you press play. From that moment, YouTube may set cookies and process data under its own privacy policy.
- 360° virtual tours open on imagemotti360.cloud, and links to Instagram, LinkedIn, Facebook and YouTube open those platforms, each with its own privacy policy.
Google and Cloudflare may process data in the United States under the EU–US Data Privacy Framework. Jotform may also process data in the United States; its privacy policy describes the safeguards it applies.
6. Who receives the data
Your data is never sold. It may be processed, on my behalf and only for the purposes above, by the website hosting provider, the email provider, Jotform (the contact form) and Cloudflare (visit statistics), acting as data processors.
7. How long data is kept
- Enquiries that do not lead to a commission: up to 24 months after the last contact.
- Data linked to commissions and invoices: 10 years, as required by Italian law (Art. 2220 of the Civil Code).
- Server logs: for the period set by the hosting provider.
8. Your rights
You can ask at any time to access, correct or delete your data, to restrict or object to its processing, and to receive it in a portable format (Articles 15–21 GDPR). Write to motti@imagemotti.com. You also have the right to lodge a complaint with the Italian data protection authority, the Garante per la protezione dei dati personali (garanteprivacy.it).
9. Changes
This policy may be updated. The date at the top shows the latest version.
